Who we are & Definitions

“Underdog” means Underdog Productions (Pty) Ltd, a proprietary limited company. 

“Underdog website” means the Underdog Productions (Pty) Ltd website located at www.underdog.co.za and includes any part or element thereof.

“User” means any person who enters or uses the Underdog website, notwithstanding the fact that such a person only visited the home page of the Underdog website;

Underdog is consulting and specialist cross-media content company which produces television programming and films, for its clients and a broader global audience. It frequently exploits its intellectual property in multiple platforms. Its CEO now works as a specialist executive producer for others in the film and television industry including producer and broadcasters.

Data we collect

When visitors leave comments on the site or complete forms or make contact with us we collect the data shown in the respective forms, and also the visitor’s IP address and browser user agent string to help spam detection.

  • Underdog shall take all reasonable steps to protect the personal information of Users and for the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA) of South Africa and Protection of Personal Information Act Act No. 4 of 2013 ;
  • Underdog may electronically collect, store and use, amongst other, the following personal information of Users:
    • Name and surname (where such users have subscribed to a database or e-mailed us via a form);
    • Contact details;
    • Industry Sector;
    • Non-personal browsing habits and click patterns;
    • E-mail address;
    • IP address, and
    • This site is protected also by reCAPTCHA and the Google Privacy Policy and Terms of Service apply.
    • Appointment Booking with Calendly
    • We use Calendly to allow users to book appointments directly through our website. When you schedule a meeting, Calendly may collect personal information such as your name, email address, and selected meeting time. This information is used solely for scheduling and communication purposes.
      • Cookies and Tracking
        • Calendly may use cookies or similar tracking technologies to support its booking functionality, such as remembering user preferences and ensuring availability. If you have disabled or hidden cookie consent banners, please note that Calendly cookies may still be set automatically.
        • Calendly’s privacy practices are governed by their own Privacy Policy. By using our booking system, you agree to Calendly’s processing of your data as described therein.
        • If you prefer not to share your data with Calendly, you may contact us directly to arrange an appointment.
  • Underdog collects stores and uses the above mentioned information for the following purposes:
    • Communicate requested information to the User;
    • Newsletter database;
    • Possible future registration and / or authentication of Users; and
    • To compile non-personal statistical information about browsing habits, click-patterns and access to the Underdog website;
  • Information detailed above is collected either electronically by using cookies or is provided voluntarily by the User. Users may determine cookie use independently through their browser settings;
  • Underdog may collect, maintain, save, compile and disclose any information collected from users, subject to the following provisions:
    • Underdog shall not disclose personal information from Users unless the User consents thereto;
    • Underdog shall disclose information without the User’s consent only through due legal process; and
    • Underdog may compile, use and share any information that does not relate to any specific individual; and
  • Underdog owns and retains all rights to non-personal statistical information collected and compiled by Underdog.

How we protect any personal info

  • Underdog shall take all reasonable steps to secure the information provided by and collected from Users from unauthorised access and/or disclosure. However, Underdog does not make any warranties or representations that content shall be 100% safe and secure;
  • Underdog is under no legal duty to encrypt any content or communications from and to the Underdog website and is also under no legal duty to provide digital authentication of any page on the Underdog website and;
  • This site is may be protected by reCAPTCHA and the Google Privacy Policy and Terms of Service apply.

Cookies

If you complete a form on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave complete another forms. These cookies will last for one year.

If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in (if this is enabled in future), we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Underdog owns and retains all rights to non-personal statistical information collected and compiled by Underdog.

Cloudflare Turnstile
We use the bot detection service “Turnstile” from Cloudflare, Inc. (101 Townsend St., San Francisco, CA 94107, USA). This service is used to verify whether data entered on our website (e.g., in a contact form) has been entered by a human user or by an automated program.

To do this, Turnstile analyzes the behavior of website visitors based on various characteristics. This analysis starts automatically as soon as a visitor enters a page where Turnstile is enabled. Turnstile evaluates information such as the visitor’s IP address, browser information, and mouse movements.
The data collected during the analysis is forwarded to Cloudflare. This processing is based on our legitimate interest in protecting our web offerings from abusive automated data collection and spam. As the data controller, we have a legal obligation to inform you that your data is processed by a third party.

How long we retain your data

There is no time limit on how long we keep statistical information.

What rights you have over your data

You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Where your data is sent

Visitor comments may be checked through an automated spam detection service and is sent directly to the CEO Marc Schwinges, who travels all over the world with such data and also stores copies in various cloud services, notably Apple iCloud.

Statistical information is stored either using Google Tracking or reCAPTCHA services or on the web server itself, which is located in Europe.
